1. Introduction
Welcome to BrightKey PR. These Terms and Conditions ("Terms") govern your use of our public relations and marketing services. By engaging our services, you agree to be bound by these Terms.
2. Service Description
BrightKey PR provides comprehensive public relations services including but not limited to media relations, content creation, strategic communications planning, crisis management, and brand positioning. Our services are tailored to meet the specific needs of each client.
3. Client Responsibilities
As our client, you agree to:
- Provide accurate and complete information necessary for campaign execution
- Respond promptly to requests for approvals, feedback, and materials
- Maintain confidentiality of proprietary strategies and methodologies
- Make timely payments according to agreed-upon terms
- Provide necessary access to key stakeholders and decision-makers
4. Payment Terms
Payment terms are specified in individual service agreements. Generally, retainer fees are due monthly in advance, and project-based fees are payable according to agreed milestones. Late payments may incur additional charges and may result in suspension of services.
5. Confidentiality
BrightKey PR maintains strict confidentiality regarding all client information, strategies, and proprietary data. We require all team members to sign non-disclosure agreements and implement secure data handling procedures to protect client interests.
6. Intellectual Property
Content, strategies, and materials created specifically for clients remain the property of the client upon full payment. However, BrightKey PR retains rights to general methodologies, processes, and non-client-specific knowledge developed during service provision.
7. Limitation of Liability
While BrightKey PR strives for excellence in all services, we cannot guarantee specific outcomes such as media coverage, audience engagement levels, or business results. Our liability is limited to the total amount paid for services in the preceding twelve months.
8. Termination
Either party may terminate services with 30 days written notice. Upon termination, clients remain responsible for payment of all services rendered and expenses incurred up to the termination date. All confidentiality obligations continue indefinitely.
9. Governing Law
These Terms are governed by the laws of the jurisdiction in which BrightKey PR operates. Any disputes arising from these Terms or our services shall be resolved through binding arbitration or in the courts of competent jurisdiction.
10. Amendments
BrightKey PR reserves the right to modify these Terms at any time. Clients will be notified of significant changes, and continued use of our services constitutes acceptance of modified Terms.
11. Refund & Cancellation Policy
Press Release Creation: Press release drafting is provided free of charge and has no monetary value. No refunds apply to the drafting stage.
Distribution Services: Once payment for distribution has been made, resources are immediately allocated and distribution access is scheduled. For this reason, payments are generally non-refundable. However, if a client reaches out directly with a refund request, we will review it in good faith and may, at our sole discretion, consider a partial or full refund depending on the circumstances.
Client Approval Requirement: Distribution requires client approval of the draft press release. If a client fails to provide approval or communication, the service is deemed "available for delivery," and no refund will be issued.
Delivery Timeline: Distribution will occur within 48 hours of client approval, and a comprehensive media report with live placement links will be provided after distribution is complete.
Cancellation Requests: A cancellation request may be submitted within 24 hours of payment if distribution has not yet begun. After this period, cancellations are not accepted.
Refund Requests: If a client reaches out directly to request a refund, we will review it in good faith. Depending on the amount of work already completed and outreach already performed on the client's behalf, we may, at our sole discretion, consider a partial or full refund.
